JUDGMENT 1. - In this writ petition, the petitioner has prayed for direction to the respondents to pay the petitioner the pensionary and retirement benefits. 2. A notice was issued to the respondents to show cause as to why this writ petition should not be admitted and disposed of. Notices have been served on the respondents in the month of April, 1990. After the case was listed on 7.8.90, two weeks' time was granted to the respondents to file reply. No reply has been filed by the respondents till date. 3. Shri M.K. Kaushik, learned Dy. Govt. Advocate has requested for grant of further opportunity. However, looking to the nature of the case, I do not think it proper to grant time. 4. The petitioner had retired from service on June 30, 1989 after having rendered more than 31 years of service as a teacher. Despite retirement, the pensionary benefits have not been given to her and this compelled her to approach this court to file this writ petition. 5. Shri Narendra Jain, learned counsel for the petitioner has stated before the court that in the month of July, 1990, the petitioner has been paid her pension from June, 1989 to June, 1999. She has however, not been paid full gratuity amount. 6. The respondents have not shown any reason as to why the pensionary benefits have not been paid to the petitioner for a period of more than one year. The Govt, which claims that it is a welfare State, treats its retired employees with contempt and are made to suffer for months together to get their retirement benefits. This shows that in reality, the Government authorities act in contravention of the slogan of Welfare State. Though the payment of pension has been made to the petitioner up to the month of June, 1990, I feel it appropriate that the respondents must pay interest to the petitioner on the amount of pension at the rate of 15% from 1st August, 1989. The amount of gratuity, which is still due to the petitioner, must be paid to him (sic her) within 15 days from the date of presentation of this order. The respondents shall pay costs of Rs. 500/- for unnecessary harassment caused to her on account of non-payment of pension and gratuity. The amount of interest shall be paid within one month, 7.
