JUDGMENT 1. Heard learned counsel for the parties. 2. The sealed envelopes were produced before this Court from the Registry. Mr. G.C. Garg, appearing on behalf of the Rajasthan Small Industries Corporation and Mr. R.C. Joshi, appearing on behalf of the M/s Jaiswal Kutir Udhyog Ltd. Jaipur, appellant in other case and Mr. C.K. Garg, learned counsel for M/s Vanita Handicrafts, Jaipur, have agreed and submitted that the sealed enveloyes should be opened in the court and the highest bidder should be given an opportunity of opening of counter of readymade garments at Delhi, which is in dispute. It was also agreed upon that the remaining part shall be considered from 1st October, 1990 to 31st March, 1991, and other terms and conditions shall be the same. In the presence of both the parties, the sealed envelopes were opened in the Court. The Vanita Handicrafts has offered tender for the sale of readymade garments of Rs. 21.05,010/- from 1st October, 1991, to 31st March, 1991, Jaiswal Kutir Udhyog has offered the tender of sale of readymade garments of Rs. 21,0,522/- for the same period. Thus, the tender of Vanita Handicrafts is higher than the tender of Jaiswal Kutir Udhyog. In view of this after entering into a fresh agreement, the contract should be given to Vanita Handicrafts, as agreed upon by both the parties. 3. The original tenders and the sealed envelopes duly signed by the learned Additional Registrar (Judl), may be handed over to Shri G.C. Garg. Vanita Handicrafts will execute the agreement within 10 days from today, and the appellant Corporation shall give due co-operation to Vanita Handicrafts. In case, the Vanita Handicrafts, does not execute the tender within 10 days from today, the appellant shall be free to act according to law and the appellant shall also be free to give contract to Jaiswal Kutir Udhyog. 4. The order of the learned Single Judge, is modified as indicated above and the appeal is disposed of accordingly in terms of the directions given hereinabove.Appeal disposed of. *******
