ds fuEu vak egRoiw.kZ gS] ftUgsa mn~/k`r fd;k tkuk mfpr gksxk %& "The firding of the Munsiff, although at the requistion of the criminal court, is in a civil proceeding and it is on that basis that section 146 (ID) had to be provided, so that no fruther challenge of that finding may be made in the hierarchy of Civil Court. Section 439, Cr.P.C. also necessary must relato to a criminal proceeding and in subordinate court. Since under section 146 (IB), the criminal court has no other option than to pass an order in conformity with the decision of the civil court, it remains a decision of the civil court which is acted upon by the criminal court. It will be open in criminal revision to challenge the order of the Magistrate only when it is not in conformity with the decision of the civil court or if there is any other illegality in the proceeding before the Magistrate. The finding of the civil court throughout remains as such even after it is being transmitted to the Magistrate and that finding cannot be challenged either before the Magistrate or in revisions under Ss. 435 and 439, Cr.P.C. if the civil court commits any breach of fundamental principles of law or such other gross illegalities, it would be open to the aggireved party to move the High Court by means of an appropriate application under Article 227 of the Constitution and in exercise of the power of superintendence the High Court may look into the matter and pass such orders as may be necessary. The question of value of the subject-matter is irrelevant in a proceeding under section 145, Criminal P.C. since the dispute centers round the likelihood of breach of peace with regard to the immediate possession of immovable decesion of the Civil Court with regarcd to right and title of the land and other reliefs." 14- blh izdkj pUnzks[kjflag cuke fl;kjkeflag ¼mijksDr½ esa ekuuh; mPpre U;k;ky; us ;g fuf.kZr fd;k gS fd /kkjk 146 n.M izfØ;k lafgrk ds rgr flfoy U;k;ky; }kjk fn;s x;s fu"d"kZ dks vihy ;k iqujh{k.k esa pqukSrh ugha nh tk ldrhA mDr fu.kZ; ds iSjk la[;k 9 dks ;gka mn~/k`r djuk mfpr gksxk %& "An examination of the provisions of section 146 of Criminal Procedure Code of 1898 would show that the finding of the Civil Court on a reference by the Magistrate regarding possession cannot be appealed against or challenged by way of review or revision. Though the Civil Court acting under Section 146 (IA) and (IB) of Section 146, Criminal Procedure Code, has not ceased to be a civil court, the finding regarding possession given by the Civil Court cannot be challenged by an appeal, revision or review. This Court in Ramchandra Aggarwals case (1966) SCR (Supp) 392; ( AIR 1966 SC 1888 ) held that neither an appeal nor a revision lies against the finding of the Civil Court in the reference because of the express provision in Section 146 (ID) and not because the proceeding before the Civil Court is not a civil proceeding. The wording of Section 146 (ID) puts the matter beyond any controversy. Sub-section (1-D) reads as follows :- "No appeal shall lie from any finding of the Civil Court given on a a reference under this Section nor shall any review or revision of any such finding be allowed. The sub-section makes it clear that the finding of the Civil Court cannot be questioned by way of an appeal. It also prohibits any challenge to the finding by way of review or revision.
