JUDGMENT 1. Petitioner (a constable) seeks quashing of the order dated 11990 (Annexure 1 to the writ petition) suspending him OB the charge that one Shri Hori Lal, son of Shri Govind was unauthorisedly kept in the lock up and later he was released by the petitioner and that this fact was found to be correct on enquiry. 2. In paragraph 6 of the petition it is averred that no departmental proceedings or any enquiry is pending and, therefore, suspension is bad in law in view of Regulation 496 of the U.P. Police Regulations. 3. The petition is, therefore, disposed of finally with the observations that if no enquiry was pending when the suspension order was passed on 1191990, then the suspension order will stand revoked immediately. 4. A certified copy of this order may be given to the learned counsel, on payment of usual charges, within three days.
