JUDGMENT B.M. Lal, J. - Heard Sri Ajeet Kumar, appearing for the petitioner and learned standing counsel. 2. In this case twice time was granted to learned Standing Counsel for tiling Counter-Affidavit but yet no Counter-Affidavit has been filed. Under the circumstances, it has to be concluded that the land belonging to the petitioners was acquired by the State Government for the purposes of Construction of a Degree College. According to the Government order dated 21-2-1980 issued by the State Government a copy, thereof the has been filed as Annexure No. I to this petition, the persons whose land has been acquired one member of his family is entitled for Appointment According to his qualification and age, and therefore the petitioner has prayed that he may be appointed in Class III in any of the department of respondent No. 1 may be in Education Department or any other department in accordance with the aforesaid Government order. 3. A perusal of the Government order prima facie demonstrates that one member of the family whose land has been acquired by the Government, is to be accommodated as observed above. 4. It may also be mentioned here that on an application made by the petitioner, has Collector Pilibhit (Respondent No. 2) vide his letter dated 31-3-1991 (Annexure No. 4) addressed to the principal, Government Degree, College, Bisalpur, Pilibhit has also recommended the appointment of the petitioner in accordance with the Government order referred to above. 5. Since no Counter-Affidavit has been filed and the Government order is clear in terms giving a right to the petitioner, in the opinion of this Court, it is a fit case in which the authority concerned may be directed to appoint the petitioner. 6. Accordingly, the respondent No. 1 is directed to appoint the petitioner No. 2 on any post commensurate with his educational qualification within a period of three months from the date of presentation of a certified copy of this order before him. 7. The petition stands allowed at the admission stage.
