JUDGMENT 1. - The petitioner is a resident of Mahesh Nagar Colony, Jaipur,and his house is constructed on the Plot No. C-9, situated on 80' wide road in the said Colony. He has filed the present petition in his personal capacity, as well as, in the shape of public interest litigation to seek redress of various grievance of the inhabitants of the said Colony. It has been alleged in the writ petition that the said Colony is a residential Colony and on the 80' wide road no one can establish/construct any shop, restaurant etc. and attempts have been made by certain persons to construct shops illegally but still no action is being taken by the J.D.A. Further grievance is about non-performance of the statutory duties by J.D.A. which have been detailed out in the writ petition. 2. I need not go into the details of the various averments made in the writ petition, as Mr. R.S. Mehta, learned counsel for J.D.A. has made the following statement, on behalf of and under the authority of J.D.A., for the redress of the said grievances (SEEK) made in the writ petition:- (i) That the repairing work of the road in question has been started by the J.D.A. and this fact has been admitted by the learned counsel for the petitioner also. The learned counsel for the J.D.A. further gives out that the necessary repairing of the road shall be completed by the J.D.A. (ii) Mr. Mehta further gives assurance that the survey work of the bridge to connect Mahesh Nagar Colony with Bais Godam area has been completed and the construction work of the bridge shall be started as early as possible subject to the availability of finance. (iii) Mr.Mehta further assures that the street light shall be provided in the Colony as early as possible. (iv) Mr. Mehta further gives out the assurance on behalf of J.D.A. that if any specific complaint about illegal encroachment/construction is made to the J.D.A., then action shall be taken by it in accordance with law. 3. In view of the aforesaid statement/assurances made by Mr. Mehta, the learned counsel for the J.D.A., the learned counsel for the petitioner is no more interested to further prosecute the present writ petition.The writ petition is, therefore, disposed of accordingly. The costs of this petition is made easy.Writ Petition Disposed of Accordingly. *******
