Order This writ application has been filed for quashing the order dated 5.6.1990 contained in Annexure-6 passed by the respondent, Civil Surgeon-cum-Chief Medical Officer whereby the petitioners have been informed that no appointment letters are being issued to them because of the Government order contained in Teleprinter Message dated 10.5.1990 contained in Annexure-7 by which the Government has cancelled the appointments made by the Civil Surgeon. 2. According to the petitioners they were selected for making appointment after following all the procedures required under the law. On behalf of the State a counter-affidavit has been filed, wherein it has been accepted that there was no irregularity in the selection of the petitioners. It has been further stated that the aforesaid order contained in Annexure-7 has been withdrawn by the State Government and by Government order dated 11.1.1991 a fresh committee has been constituted for the purposes of making selection with regard to the Class-III and IV employees under the Health Department. Since even according to the State there was no irregularity in selection of the petitioners, therefore, in our view the committee which has been constituted by the Government order dated 11.1.1991 is not required to take up the matter regarding selection of the petitioners, as the said circular will apply only to those cases where either the vacancies have accrued after the date of the aforesaid Government order or the same were in existence at (sic) of said circular and there were irregularities in making. 3. Accordingly, this writ application is allowed and the respondent. Civil-Surgeon is directed to take Steps for appointment of the petitioners in accordance with law on the basil of the selection already made. 4. With the aforesaid direction this application is thus disposed of.
