K. J. VAIDYA, J. ( 1 ) RULE. Mr. K. C. Shah the learned APP. waives service of Rule. ( 2 ) THE petitioner Jitubhai Shamjibhai and two others who happen to be mother-in-law and father-in-law of the deceased Rekha were arrested by the police in connection with CR. No. 55/91 registered at Mahuva police station for the alleged offences under Section 302 read with Section 34 of IPC have by this Misc. Cri. Application moved this court praying for getting themselves released on bail challenging the impinged judgment and order dated 10-9-1991 passed by the learned Additional Sessions Judge Bhavnagar whereby their bail application bearing M. C. A. No. 584/91 came to be dismissed. ( 3 ) MR. Parikh the learned Advocate for the petitioners having argued this matter at length and ultimately realising that this court was not inclined to grant this bail application sought permission to withdraw this application. At the same time Mr. Parikh also requested this court that since the bail application is rejected and as the charge-sheet is already submitted before the Sessions Court and one of the petitioners being a lady member this court may broadly on humanitarian ground direct the Sessions Court to expedite the trial. This request is quite reasonable and is granted. As a matter of fact the learned APP has also fairly taken no objection to this request of Mr. Parikh being granted. ( 4 ) IN the result this application stands disposed of as withdrawn. However taking into consideration the facts and circumstances of this case since the bail application is rejected as withdrawn and one of the petitioners being a lady member the learned Sessions Judge is directed to give topmost priority to the case by fixing the trial at the earliest possible. In fact whenever in such cases wherein some women are arraigned as accused persons and they are not released on bail it is highly desirable that trial of such accused persons are given top- most priority over other accused and the same is conducted at the earliest possible opportunity. (Emphasis supplied.) All the learned Sessions Judges of the State are accordingly directed to keep in mind the above guideline while dealing with such cases. Rule discharged.
