ORDER : Ranganath Misra, C.J.I. 1. We have seen the report of the Chief Judicial Magistrate who under our direction visited the TB Hospital on several occasions at different parts of day without notice to anyone. On the surprise visits he has found, as it appears from his report, that the Superintendent was not found except on one occasion, the diet has not been up to the prescribed standard, milk has not been available on various occasions, meat and eggs have not been provided, insanitary condition continues, water has not been available and the TB patients are forced to walk up to a distance of 200 metres to get water from public places. The medicine that has been supplied is spurious. Registry is directed to seal up the samples of medicine, have them sent to ICMR and have them tested to find out whether they are suitable to be used for patients suffering from TB. The report be received by the Registry within four weeks. The matter is directed to be re-listed four weeks after to examine whether the doctor and others should be criminally prosecuted. In the meantime, we commend to the Chief Secretary to the State that, he may put both the doctor and the Superintendent under suspension, have appropriate charges drawn up on the basis of the report (copy of the report should be forwarded to the Chief Secretary) and report to this Court as to what action has been taken within four weeks from today. The matter is adjourned to August 9, 1991. If necessary, the report of the Chief Secretary may be transmitted by speed post or by special messenger so as to reach here before the date. 2. Substitutes be placed in the hospital as soon as suspension becomes operative.
