Order B.N. Agrawal, J. Heard learned counsel for both the parties. This application has been filed for quashing prosecution of the petitioners in Case no. 18 of 1977 pending in the court of sub-divisional Judicial Magistrate Lakhisarai. It appears that the laid case was instituted in the year 1977 and since no final form was received in the court below, the petitioners moved this court for quashing the proceeding. This court by its order dated 27.11.1990 called for a report from Superintendent of police, Munger, with regard to progress of the case. Pursuant to the said order, the Superintendent of police submitted a report to the effect that final for had been submitted but the same was not received in court. In his report, the Superintendent of police said that he is making enquiry as to why the final form has not been received in Court. Accordingly, the Superintendent of Police was directed by this court on 26.2.1991 to submit a fresh report. Since prosecution of the petitioners is pending since last 14 years and no cognizance has been taken as yet, in my view, it is a fit case where prosecution should be quashed, a petitioner no. 1 is a Government servant and he has retired from service, Because of pendency of the present case, his post-retirement benefit is not being paid to him. In view of there facts, I am of the view that prosecution of the petitioners should be quashed. It is made clear that now post-retirement benefit shall be paid to the petitioner no.1 as if no such case ever remained pending against petitioner no. 1. In the result, this application is allowed and prosecution of the petitioners is hereby quashed. Application allowed.
