Sukumar Barman alias Sulku and another through Chander Kumar Banik v. State of West Bengal

1991-07-16

KULDIP SINGH, M.H.KANIA, RANGANATH MISRA

body1991
ORDER : Ranganath Misra, C.J.I. 1. These writ petitions were entertained on the basis of postal communication received by the Court. An order was made on June 6, 1991 during the vacation staying the execution. 2. The State has now appeared and filed its counter-affidavit. From the history of the case, it appears that after conviction and sentence of death imposed by the trial court had been affirmed by this Court, a review was filed which too was dismissed. The present attempt is intended to protract the logical consequence of the punishment which has been affirmed. We do not think there is any justification to entertain the writ petitions and enter into a fresh examination of the matter. 3. The writ petitions are accordingly dismissed. Counsel for the respondent is made aware of the order. Inform the petitioners.
