Judgment SATYESHWAR ROY and R.N.SAHAY JJ. 1. It appears from the order of the Court below that the accused in the sessions trial have been convicted and the appeal filed by them in this Court is pending. 2. In this appeal the question is for releasing the D. B. B. L. Gun bearing No. 6448/136 which was taken away by the dacoits from the house of the deceased Ramji Bhagat. 3. We are of the opinion that the gun in question is material exhibit, and it shall have nothing to do with the hearing of the appeal filed by the convicts. 4. In the circumstances, it is ordered that the aforesaid B. B. B. L. Gun subject-matter of S. T. No. 274 of 1989 shall be released in favour of the appellant (Bijay Kant Prasad). 5. This appeal is disposed of.
