JUDGMENT Bhawani Singh J.—The petitioner has filed this petition seeking relief to direct the respondents to allow his migration from Jawahar Lal Institute of Post. Graduate Medical Education and Research, Pondichery, to Indira Gandhi Medical College, Shimla, in three year MBBS Course. 2. The case of the petitioner for migration has been recommended by his above parent Institute at Pondichery (Annexure-PA). However, the second respondent has raised some objection against this migration. The tenor of the objection appears to be that the matter of the petitioner was not got approved within a period of three months. 3. The petitioner submits that the delay in this case is not on his part. As a matter of fact, it has been occasioned for the reason that the matter remained with the third respondent, who has also now decided the matter in his favour on 3-5-1990 (Annexure-PD). 4. Shri P. A. Sharma, learned Senior Standing Counsel for the Central Government, also submits that giving of approval is just a formality since the case of the petitioner has been recommended by his College at Pondichery as well as the Himachal Pradesh University. The delay on the part of the fourth respondent has been on account of the formation of new Committees in place of old Committees, which have been declared illegal by the Supreme Court of India. 5. After hearing the learned Counsel for the parties and looking into the matter quite carefully, I am of the considered opinion that the relief claimed by the petitioner is absolutely genuine and deserves to be allowed. The case of the petitioner, as recorded hereinabove, has been recommended by the Jawahar Lal Institute of Post-Graduate Medical Education and Research, Pondichery, as well as by the Himachal Pradesh University. The objection of the second respondent against the migration of the petitioner is not of very serious nature. Moreover, the petitioner is not responsible for the delay in this case. 6. Accordingly, this writ petition Is allowed and the respondents are directed to regularise the migration of the petitioner to Indira Gandhi Medical College, Shimla, and the petitioner be deemed to be a student of this Institution for all intents and purposes. The deficiency of lectures, if any, will be condoned by the appropriate authority. No order as to costs. Writ petition allowed.
