Judgment B.C.Basak and L.P.N.Shahdeo JJ. 1. The employee has retired in the year 1979 and died in March, 1991. His widow has come up before this Court in May, 1991. On 8-5-1991 order has been passed by this Court which speaks for itself. Now it has come up before us for disposal for grant of penal interest and costs. 2. On account of negligence and latches of the officials concerned, the petitioner could not get his pensioner post-retirement benefits including the Provident Fund amount for 12 years and only when she made this application that the amount was paid. 3. In that view of the matter, we direct that interest Rs. 20% per annum, to be calculated from the date of the retirement of the concerned employee, be paid and also costs which is assessed at Rs. 2,000. 4. Out of this amount, a sum of Rs. 10,000 is to be paid to the petitioner by 11th October, 1991 i.e., before the Puja Vacation and the balance amount shall be paid by 30th October, 1991. 5. In case of non-payment, put up this matter before this Bench for taking necessary action. 6. We also direct that an enquiry be made to find-out as to the persons responsible for such latches and negligence and steps be taken against them in accordance with law, for recovery of the amount directed to be paid as interest and costs from them.
