JUDGMENT U.K. Varma, J. - This revision has been filed against the order of the III Addl. Munsif Magistrate, Varanasi dated 25.1.91 summoning the petitioners Tulsi Ram, Satya Deo, Guru Charan, Lolara and Kedar Nath in a case under Sections 452, 427, 394, 395 and 594 I.P.C. The counsel for the petitioner argued that since the case is shown to be one under Section 395 Indian Penal Code also it was incumbent for the Magistrate to examine all the witnesses before the petitioners could have been summoned. There is no doubt force in this argument but it could not be inferred that besides the two witnesses examined, the complainant had to examine other witnesses. The order summoned the petitioners thus does not suffer from any illegality, warranting interference in revision. The revision as such, is summarily dismissed. The Magistrate, however, would do well to dispose of the bail application of the petitioner when moved before him on the same day. 2. Copy of this order may he given to the learned counsel for the revisionist on payment of usual charges within three days.
