JUDGMENT : Kuldip Singh, J. 1. We have today pronounced judgment in Civil Appeal No.1277 of 1979 and Civil Appeal No. 4109 of 1984. For the reasons given in those appeals we allow this appeal with costs and set aside the judgment of the High Court. The suit of the respondent is dismissed. We quantify the costs as Rs. 5,000/-.
