JUDGMENT Mr. Surya Prasad, J. - This is a criminal revision against the order dated 22nd August, 1991 passed by Sri Y.C. Gupta, Chief Judicial Magistrate, Bijnor in Case No. 26 of 1991 (State v. Unknown) permitting further investigation in case crime No. 138 of 1990 under Section 364/302/201 I.P.C. pertaining to the Police Station Nehtaur, district Bijnor. 2. Heard the learned Counsel for the parties and perused the impugned order in particular. 3. The police submitted the final report after investigation on 10th June, 1991. That final report was accepted by the learned Judicial Magistrate vide his order dated 10th June, 1991. Thereafter an application was moved by Sri Raten Lal Gautam, SI.S Bijnor for permission to re-investigate into the matter. The learned Chief Judicial Magistrate passed the following order on 22nd August 1991 : ORDER Perused and heard. Further investigation is permitted as prayed. Sd/- (Y.C. Gupta) C.J.M. The learned Counsel for the revisionists has vehemently argued that the order dated 10th June, 1991 accepting the final report has become final and, therefore, the learned Chief Judicial Magistrate could not have passed the impugned order. Not only this, but there is also no additional ground or material in the application moved for permission of further investigation in the case. In view of all this, the learned Counsel for the revisionists has ultimately argued that the order is baseless, illegal and perverse. His contention does not appear to be devoid of force. 5. In the result, the revision is allowed. The impugned order dated 22nd August, 1991 is set aside.
