JUDGMENT Bhairo Prasad, M. - This revision has been tiled under Section 333 of U.P. Act No. 1 of 1951 against the order of the Additional Commissioner Gorakhpur Division, Gorakhpur dated 30.4.92. 2. The revisionist filed a transfer application in the court of Additional Commissioner against Upper Collector, Maharajganj regarding a proceeding under Section 198 (4) of U.P. Act No. 1 of 1951. The learned Additional Commissioner has rejected that transfer application against which this revision has been filed. 3. I have heard the learned counsel for the revisionist and have perused the record. 4. In the transfer application the court of the Commissioner and this Court have concurrent jurisdiction. The court of Commissioner can transfer the cases from one court to another court within his jurisdiction. The Board has power to transfer the case from any court in the State. Regarding the allegation the Additional Commissioner has already concluded the finding that there is no justification to transfer the case. There is no allegation also that the case should be transferred from the court of Gorakhpur Division to another division of the State. Hence there is no ground in this revision. Moreover the proceedings are still pending and it has not been decided, therefore, no revisional interference is needed when the case is not yet decided. I do not want to exercise my jurisdiction of revisional power in such cases because if such cases are allowed then it will be very difficult to decide any proceeding. In these circumstances of the case this revision is rejected.
