JUDGMENT Bhairo Prasad, M. - This transfer application has been moved against the Additional Commissioner-I, Gorakhpur Division, Gorakhpur regarding the appeal No. 285/D of 1987 and 286/D of 1987 pending in his court. 2. I have heard the learned counsel for the petitioner. Now the distribution of judicial work is done by the Commissioner amongst the Additional Commissioners, therefore, the Commissioner has a power to recall the file from the court of any Additional Commissioner for the purpose of disposal either by himself or to assign to some other court for disposal. If he is satisfied that there is sufficient reason to withdraw that file. No prayer has been made to transfer the above appeal from Gorakhpur Division to any other Division of the State, hence the remedy available to the petitioner can be availed by filing this petition before the Commissioner Gorakhpur Division, Gorakhpur. Therefore, this petition is transferred to the court of Commissioner, Gorakhpur Division, Gorakhpur for disposal. Meanwhile the trial court will not dispose of the appeal.
