TIBREWAL, J.— Heard. 2. The contention of the learned counsel for the petitioner is that the petitioner is an old man aged 73 years and that he happens to be the landlord of the complainant party. He argued that M/s Popular Bread Factory which was being run by the tenants has wound-up the business from Kota and shifted to Indore. He also argued that a civil suit was filed by him on Sept. 24, 1991 bearing Civil Suit No. 465/91 in the Court of Munsiff South, Kota for the recovery of Rs. 2750/- against the partners of the said firm. According to the learned counsel, this complaint has been filed on 19/11/1991 at P.S. Gumanpura Kota in order to pressurise the petitioner. 3. After going through the averments made in the complaint and taking into consideration all the facts and circumstances and the age of the petitioner, I am inclined to grant him pre-arrest bail under section 438 Cr. P.C. 4. The SHO/Arresting Officer, Investigating Officer, Police Station Gumanpura, Kota in F.I.R. No. 702/91 is, therefore, directed that in the event of arrest of petitioner Gordha Singh S/o Sh. Aidana Ram, he be released on bail, provided he furnishes a personal bond in the sum of Rs. 5,000/- (Rupees five thousand only) with one surety in the like sum to his satisfaction on the following conditions :— i) that the petitioner shall make himself available for interrogation by a police officer as and when required; ii) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with, the facts of the case, so as to dissuade him from disclosing such facts to the court, or to any other police officer; and iii) that the petitioner shall not leave India without the previous permission of the court.
