JUDGMENT Bhairo Prasad, Member. - This reference has been referred by Additional Commissioner, Agra Division, Agra vide his recommendation dated 16-2-87 in revision under Section 333-A of U.P. Act No. 1 of 1951 arising out of the order of the Assistant Collector 1st Class, Aligarh dated 30-6-86 in suit under Section 176 of U.P. Act No. 1 of 1951. 2. In brief the facts of this case are that during the partition suit Naubat Singh and others filed an application before the trial court that they are necessary parties in the partition suit because the suit under Section 180 of Uttar Pradesh Tenancy Act was decided between the parties regarding Plot No. 3442 area seven biswas. This application was opposed by the revisionist. But the trial court granted the application of Naubat Singh and others to be impleded as a party vide order dated 30-6-86. The plaintiff Bhoop Singh and others filed a revision before the Commissioner against that order. The learned Addl. Commissioner has recommended that in a partition suit only recorded person can be made a party. Naubat Singh and others are not recorded tenure-holders, hence they cannot be impleaded as party. 3. I have heard the learned counsel for both the parties. Perused the record. 4. Beside this the judgment of the Additional Commissioner of the suit under Section 186 of Uttar Pradesh Tenancy Act is on record. A perusal of judgment itself shows that plot No. 3442 had two divisions, one having an areas 2-15 and another seven biswas. The area of plot No. 3542 two bigha fifteen biswas was in dispute in that suit hence on the fact also the plot No. 3442 area seven biswas was never in dispute in that suit. The plaintiff and other defendants who are recorded over the disputed plot had been recorded over this plot. Therefore, there commendation made by the learned Additional Commissioner is perfectly valid and justified. There is no case for Naubat Singh and others to be impleaded as party, therefore, the reference is accepted and the trial court's order dated 30-6-86 is set aside and the impleadment application of Naubat Singh and others dated 16-7-86 is also rejected.
