JUDGMENT Bhairo Prasad, Member. - This reference has been made by the Addl. Commissioner, Gorkhpur Division, Gorakhpur vide his recommendation dated 27.7.1987. 2. The suit was filed by Sayed Khan in the Court of Sub-Division Officer, Salempur, District Deoria. During the proceeding an application was filed by the revisionist that he should be made party as Sayed Khan had sold the disputed plot. That application was rejected and the suit was dismissed by the trial court. Revision was filed which has been preferred to this court that the order of the trial court should be set aside and the should be set aside and the case should be remanded afresh to be decided. 3. The parties have filed compromise to the effect that the revision should be accepted and the suit should be decreed on basis of compromise. 4. I have heard the learned counsel for the revisionist. No one is present from the side of the Opp. Party. Perused the record. 5. The revision is allowed and the reference is accepted. The prayer that suit should be decreed cannot be allowed because this the jurisdiction of the trial court, therefore, the case is remanded as recommended by the Addl. Commissioner to decide it afresh considering the aspect of compromise also after issue of notice to the parties.
