JUDGMENT 1. - Mr. Sunda Counsel for the petitioner submits that the parties have mutually compromised. Smt. Laxmidevi from whom the ornaments are alleged to have been snached herself is present before the Court and she in conformity with an affidavit dated 17th December, 1991 has submitted that the names of the present accused petitioners had been mentioned in F.I.R. by her brother. I have considered the above submissions and have also gone through the order dated 7th January, 92 and the case diary. Looking to the totality of the case and the facts and circumstances of the case. I am inclined to accept this bail application of the accused petitioners Mahesh and Tarachand under Section 438 Criminal Procedure Code. 2. The SHO/Arresting Officer/Investigating Officer police station, Nawalgarh, District Jhunjhunu in F.I.R. No. 51, is therefore, directed that in the event of arrest of the accused petitioners Mahesh S/o Sitaram and Tarachand S/o Jaisaram they be released on bail, provided each of them furnishes a personal bond in the sum of #2352; 10,000/- (Ten thousand) with two sureties in the sum of #2352; 5,000/- (Five thousand) each to his satisfaction on the following conditions: 1. that the petitioners shall make themselves available for interrogation by a police officer as and when required; 2. that the petitioners shall not directly, or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court, or any police officer; and 3. that the petitioner shall not leave India without the previous permission of the Court. Petition allowed. *******
