JUDGMENT Bhairo Prasad, Member. - This reference has been made by the Commissioner, Bareilly Division, Bareilly vide his order dated 15-12-1982 in a revision under Section 333-A of U.P. Act No. 1 of 1951 filed before him against the order of Collector, Pillibhit dated 22-9-1981 passed in a proceeding under Section 198 (4) of the Act. 2. The facts of the case are that no notice was issued to the Land Management Committee when the Collector decided the proceeding under Section 198 (4) of U.P. Act No. 1 of 1951. This illegality has been found out by the Commissioner in his recommendation dated 15-12-1982 that the Land management Committee is necessary party. 3. I have heard the learned counsel for both the parties. Perused the record. 4. The Land Management Committee is a necessary party in a proceeding under Section 198 of the Act as laid down in Rule 178-A (2) of U.P. Z.A. & L.R. Rules, therefore, the learned trial court has exercised the jurisdiction in a such way that a material irregularity has been committed in her order. Therefore, the reference is accepted and the order of the trial court is set aside and the trial court is directed to impliad the land Management Committee as necessary party and after giving show-cause notice to decide the case.
