JUDGMENT Bhairo Prasad, Member. - This revision has been filed under Section 333 of U.P. Act No. 1 of 1951 by revisionist Nazakat Ali Khan against the order of the Additional commissioner, Kumaun Division, Nainital dated 24-4-90. 2. An appeal was pending before the First appellate court which was dismissed on 12-10-1989. The application was also given of the impleadment of legal representative of Smt. Chhuni Begam on 21-11-1989. Another application was also given by Nazakat Ali Khan that he is legal representative of Smt. Chhuni Begam. The Additional Commissioner restored the appeal but in the same order he directed the Sub-Divisional Officer to inquire and give the report about the legal representative of deceased Smt Chhuni Begam. Against this order of the first appellate court this revision has been filed. 3. I have heard the learned counsel for the opposite-party. Revisionist is absent. Perused the record. 4. The restoration application was within time, therefore, there is no illegality in restoring the appeal. The applications were also given for the impleadment of legal representative of deceased Smt. Chunni Begam. There has been two claimants for her property, therefore a report was essential to be obtained. In these circumstances of the case the order passed by first appellate court is perfectly valid and legal. This revision is not maintainable because there is no illegality or jurisdictional error in the order of the trial court therefore, this revision is dismissed. The record of the trial court be returned to quiry of the legal representative of the deceased Smt. Chunni, Begam as has been ordered by the Additional Commissioner.
