JUDGMENT 1. - Both the sides under in structions from the respective clients who are present before this Court have submitted that the parties have resolved their differences. Husband Kallu Singh and his father submit that they would keep Smt. Raj Bala comfortably and Smt. Raj Bala is ready and willing to go and live with her husband on the understanding that she will be kept comfortably and has also submitted that she would abide by the instructions of her husband and would not move with her husband's Tau or any other person contrary to the instructions of her husband Kallu Singh. Shri Kallu Singh has submitted that he would withdraw the divorce petition which is filed against his wife Smt. Raj Bala and Smt. Raj Bala has submitted that she would withdraw her application under Section 125, Criminal Procedure Code and all other matters which she has filed against her husband or in-laws Shri Kallu Singh also submitted that he would also withdraw all matters which may have been filed by him against his wife or in-laws. Smt. Raj Bala has also submitted that she does not want to proceed further with the case relating to FIR No. 220/91 of Police Station, Kathoomar which she has filed against her husband and his other relations out of which this bail application has arose. Thus the parties look for a happy married life and in the facts and circumstances of this case, I do feel that when both the parties are prepared to withdraw the entire litigation which has been filed by them against each other, the continuance of any proceedings in relation to FIR No. 220/91 of Police Station, Kathoomar may be an impediment in their happy married life and even otherwise when the parties are prepared to resolve their all differences it will be an exercise in futility to allow any proceedings to go on in relation to aforesaid FIR No. 220/91.
Since the offences under which the case has been registered also include the offences which are not compoundable, it is deemed proper in the facts and circumstances of this case to order that the FIR No. 220/91 shall not be acted upon and given effect to and no investigation proceedings shall be now taken and any proceeding taken so far shall not be used for any purpose, investigation shall be closed and this chapter be treated to be closed forever. In these circumstances it is also ordered that the accused petitioners Vol. 1 to 8 shall not be arrested in relation to FIR No. 220/91.This application is disposed of accordingly. Application disposed accordingly. *******
