JUDGMENT M. Katju, J. - This writ petition has been filed against the impugned award of the Labour Court dated 30-4-1990 (Annexure 2 to the petition). 1 have heard learned stand counsel for the petitioner and Sri Shyan Narain learned counsel for the respondent No. 1. The petitioner was an employee of Irrigation Department of the U.P. Government. It is alleged that his service was terminated in violation of Section 6 (N) of the U. P. Industrial Disputes Act. The Labour Court has recorded the finding of fact that the petitioner has worked more than 240 days and Section 6 (N) of the U.P. Industrial Disputes Act has been violated as neither retrenchment compensation nor notice to pay has been given to the respondent No. 2 before the termination of service. This is a finding of fact and, cannot interfere to the jurisdiction. It has been held in Deshraj v. State of Punjab, AIR 1988 SC 1182 , the Irrigation department is an Industry. 2. There is no merits in this petition, it is accordingly dismissed. No order as to costs. Stay order is vacated.
