P. H. Parekh ( 1 ) ON a consideration of the matter we are in agreement with the view taken by the learned Single Judge of this Court and the Andhra Pradesh High Court that Jammu and Kashmir Bank is an instrumentality of the State, With all respect we do not agree with the Jammu and Kashmir High Court which took a contrary view in Jagdish Chander Gupta v. Jammu and Kashmir Bank Ltd. , AIR 1986 J and K 1. Accordingly, we dismiss the appel in limine. ( 2 ) AN oral prayer is made for grant of certificate for leave to appeal under Article 132 read with Article 134-A of the Constitution of India. Since the view of the Andhra Pradesh High Court and of the learned Single Judge of this Court is in consonance with the decision of the Supreme Court, we decline to grant the prayer.
