JUDGMENT 1. - Heard. The contention of the learned counsel for the petitioner is that there are cross cases with regard to the same incident, and that the members of the accused party have also sustained injuries, for which a report was lodged and the police after investigation has submitted a charge-sheet against the members of the complainant party for the of fences under sections - 440, 447, 323 and 324 Indian Penal Code.I have perused the charge-sheet filed by the police in this case.After going through the entire facts and circumstances and the finding arrived at by the police after investigation with regard to the possession of the disputed field, I think it just and proper that the petitioner should be released on bail under section - 439, Criminal Procedure Code.It is, therefore, directed that the accused-petitioner Badri S/o. Sh. Gudya be released on bail provided he furnishes a personal bond in the sum of Rs. 5,000/- (Rs. five thousand only) with one surety in the like sum to the satisfaction of the trial court for his appearance in the said court or any other court on all the dates of hearing and as and when called upon to do so during the pendency of the trial in this case.Application allowed. *******
