JUDGMENT - Justice G.G. LONEY, President :—In this complaint, it is alleged by the complainant that an amount of Rs. 57,000/- has been wrongfully, unauthorisedly, without cheques and without the advice of the complainant, has been discounted from his account. The complainant, vide his letters, dated 15-5-1991, 6-6-1991, and 17-1-1992, requested the opposite party, the Bank, to restore his balance. The Bank did not restore the balance of the complainant in his account and, therefore, he filed this complaint to restore to his balance of Rs. 57,000/- with interest and also claimed compensation of Rs. 75,000/-. 2. A notice was issued to the opposite party to file written version. The opposite party did not file the written version, but was represented by one Shri Kishore Mustik, Senior Deputy Manager, at the time of hearing. The complainant filed his affidavit in support of his allegations and also filed copies of his letters addressed to the Bank as well as the Statement of current account with the Indian Overseas Bank. 3. Perusal of the Statement of Account clearly shows the debit of Rs. 57,000/- illegally and irregularly from the complainant's account. The opposite party did not offer any explanation in response to the complainant's letter nor filed any written version. We, therefore, find that eloquent silence on the part of the Bank is an indirect admission of its deficiency in the service. Even otherwise from the facts placed before us, we clearly find that the opposite party, the Bank, was deficient in its service while discounting a large amount without the advice of the complainant therefore, allow this complaint and pass the following order : ORDER The complaint is allowed. The opposite party is directed to credit to the account of the complainant Rs. 57,000/- together with interest @ 18% per annum from the date of the discount of the said amounts till its restoration. However, the claim of complainant for Rs. 75,000/- towards compensation is rejected without any material on record. Complaint allowed. *****
