P. N. S. CHOUHAN, J. ( 1 ) APPLICANT by Shri S. L. Kochar. State by Shri Paliwal. Arguments heard. ( 2 ) THE applicant is alleged to have committed rape on Pramilabai a married woman aged 25 years. Some contusions were found by the doctor on her backside. It was stressed that the applicant is innocent and this case has been concocted against him on account of some monetary transactions between his family members and the husband of the prosecutrix. Some documents have been filed, (Annexures B, C, D and E,) to show that the village people have doubted the truth of the case and have made reports to various authorities. It was also mentioned that the applicant is on interim bail since 23/12/1991 and has been co-operating with the police all through. Since the investigation is practically over no useful purpose will be served by sending him to jail. On consideration of the facts, the application is allowed. In case of arrest, the applicant is ordered to be released on bail of Rs. 10,000. 00 (Rupees ten thousand only) with one surety in the like amount to the satisfaction of the Investigating Officer, on the following conditions:i. that he shall make himself available for interrogation by any officer of police as and when required by him at such place or places which he may specify and direct; ii. that he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer when called upon to do so; and iii. that he shall not leave India or his place of residence without previous permission of the Court exercising jurisdiction over him for the time being during the period his presence is required for purposes of interrogationc. c. on payment.
