JUDGMENT Bhairo Prasad, Member. - This reference under Section 333-A of U.P. Act No. 1 of 1951. 2. In the court of Tahsildar/Assistant Collector proceeding started under Section 122-B of U.P. Act No. 1 of 1951 that the opposite party has encroached upon a portion of plot No. 30 of village Rampur Chhajmal, Pergana and Tahsil Najibabad, district Bijnor. This plot is recorded as Khalihan. The final order was passed on 31.8.1978 and after hearing the parties again the proceeding was dropped on 16.2.1979. Revision was filed against that order before the Additional Commissioner who has made the recommendation that no order is given to set aside the order dated 31.9.1978. The Tahsildar has no jurisdiction to review its own order. No objection has been filed against this recommendation. 3. I, therefore, accept this reference, set aside the order dated 16.2.1979. I also set aside the other dated 31.8.1978 on the ground that the order has been written in a very casual manner on the order-sheet and it appears that some portion of the order sheet is written by the court Clerk of the trial court. The trial court is again directed to decide afresh this proceeding in accordance with law and to give finding whether the dispute plot belong to Gaon Sabha or not.
