JUDGMENT 1. - It was urged by Mr. K.K. Mehrish that as a matter of fact, the foot note serial No. 1 in S.B. Cr. Misc. Bail Application No. 681/91 was written by Radhey Shyam Sharma, Clerk of the Counsel subsequent to the signing of the foot-note by Sanjay Mehrish. It was urged that this foot-note was made by Shri Radhey Shyam Sharma when the bail application has been presented by him in the Registry, as an objection had been raised. The contention appears to be correct and in view of the fact that original serial members of foot-notes were changed, and foot-note No. 1 was namely added in the hand-writing of Sh. Radhey Shyam Sharma. 1, therefore, accept the explanation given by Shri Sanjay Mehrish in his application, and do hereby expunge the following remarks made against Shri. Sanjay Mehrish in this Court's order dated 20th November, 1991, in S.B. Cr. Misc. Application for cancellation of Bail No. 3191/91, namely : "In such circumstances, when the previous facts were very well known to them and despite that Shri Sanjay Mehrish had signed on a foot-note that no such bail-application was fitted previously, he practiced a fraud on the Court. He, by signing the foot-note, became an active party to the fraud". 2. The above adverse remarks made against Shri Sanjay Mehrish are hereby expunged this Court's order dated 20th November, 1991 in the application for cancellation of bail bearing No. 3191/91.Petition allowed. *******
