JUDGMENT The petitioner is an employee of Kshetriya Soyabeen Utpadak Sahakari Sangh Maryadit, Ujjain. He has challenged in this petition an order dated 6.3.92 suspending him during the pendency of the enquiry and attaching him to District Office Dewas pending enquiry. Shri Dilliwal, learned counsel for the petitioner submits that the action is malafide and cites several facts in favour of his contention. However, we do not find it just and proper to interfere in the enquiry of the suspension order as we are not convinced that strong case of malafides has been made out. However, the change of headquarters during suspension is not understandable. The enquiry is going on at Ujjain and there is no point in asking a suspended employee to attend at Dewas. If the apprehension of the respondent that the petitioner will create trouble at Ujjain and shall tamper with evidence by threatening witnesses is well founded, the mischief can be averted by relieving the petitioner from the obligation to remain on the premises for the entire duty period. He can be asked to report at a particular place in the factory or his employment can either be restricted within the premises of the factory or he can be asked to go away after marking his attendance. There is, however, no justification in asking him to attend at Dewas. The fear of the petitioner that the enquiry will linger on indefinately and he will have to suffer of suspension for a long period can also be allayed by directing that the enquiry should be completed within a particular time. We, therefore, direct in supersession of the order of the Board of Revenue that the enquiry against the petitioner shall be completed within a period of 3 months from today and during the pendency of the enquiry the petitioner shall be allowed to report at Ujjain only, in accordance with such further directions as to marking of attendance during suspension period as the employer may give. With these directions the petition is disposed of.
