JUDGMENT Bhairo Prasad, Member. - This reference has been recommended by the Additional Commissioner, Agra Division, Agra under Section 333-A of the U.P.Z.A. and L.R. Act vide his order dated 19.9.1983. 2. In brief fact of the case are that mutation proceeding was filed before the Tahsildar on 19.5.1981. He referred the matter to the S.D.O. for taking action under Section 167 U.P.Z.A. and L.R. Act. The S.D.O. has rejected the mutation proceeding and has ordered to take the possession of the land for which mutation proceeding was filed. His observation was that the sale deed is hit by Section 157 of U.P.Z.A. and L.R. Act. Revision was filed against that order. The Additional Commissioner has recommended that the order is without jurisdiction and it should be set aside. The only revisionist has appeared and no body has opposed the reference inspite of date fixed for appearance before this court. The Order was passed by the learned S.D.O. on the recommendation of Tehsildar. On a mutation proceeding the learned S.D.O. has passed order Under Section 163 of U.P.Z.A. and L.R. Act. Hence he has no power to pass order under Section 163 of U.P.Z.A. and L.R. Act in a mutation proceeding. Mutation proceeding is done under U.P. L.R. Act. If the transaction was voidable then the suit of G.S. was necessary. In the circumstances of the case the reference is accepted and the order of the S.D.O. dated 6.9.1982 is set aside and he is directed to decide the mutation proceeding in accordance with law. If the transaction is barred by U.P.L.R. Act then proceeding can be done in accordance with that provision separately.
