JUDGMENT Bhairo Prasad, Member. - This reference has been made under Section 333-A of U.P. Act No. 1 of 1951 by the Additional Commissioner, Agra Division, Agra vide his recommendation dated 28.8.1985. 2. No one is present inspite of the direction of the Addl Commissioner to appear in this court on 25.10.1985. Perused the record. No objection has been filed. 3. The Additional collector, Mainpuri decided a proceeding ex-parte against the revisionist on 25.1.1983. The restoration application was moved on 17.9.1984. The trial court dismissed the restoration. The Additional Commissioner has recommended the reference on the ground that no opportunity to be heard has been given to be revisionist, hence the ex-parte order should be set aside and the opportunity should be given to be heard. 4. This proceeding started on the application of Ram Autar. Prahlad, Balakram On 5.2.1982. Show cause notice was given but non has contested and the allotment was cancelled ex-parte. Hence there is sufficient ground to believe that the notice was not properly served and the opportunity was not given to the revisionist. I, therefore accept the reference and set aside the order of the trial court and allow revisionist to be heard and then proceeding should be decided afresh.
