JUDGMENT Bhairo Prasad, Member. - This revision has been filed by Roop Singh under Section 333 of U.P. Act No. 1 of 1951 against the order of the Additional Commissioner, Agra Division, Agra dated 15.7.1987 passed in a proceeding under Section 122-B read with Rule 115-C of U.P. Act No. 1 of 1951 and U.P.Z.A. and L.R. Rules respectively. 2. In the court of Assistant Collector 1st Class/Tahsildar, Kirawali, district Agra proceeding started against the revisionist that he has encroached upon a portion of plot no. 254 by opening another door in his house. Proceeding was contested by the revisionist that his house situated in the old abadi and he has opened the doors in his old abadi land. The trial court has not accepted the pleadings of the revisionist and order was passed to eject him from the land, which he has acquired and to pay damages of Rs. 1,620/- Revision was filed against this order which was dismissed by the Additional Commissioner, hence this revision under Section 333 of U.P. Act No. 1 of 1951. 3. Heard the learned counsel for the parties. Perused the record. 4. Plot No. 254 area 26-17-12 is recorded as abadi. The sketch map prepared in the trial court file also shows that it is old abadi. The revisionist has opened another door in his house where there are his cattle shed the old abadi site has been settled with the villagers and the resident of the village after the enforcement of U.P.Z.A. and L.R. Act. It has never vested in the Gaon Sabha. Hence this proceedings is not maintainable at all and the proceedings is quashing and the damages imposed is set aside.
