JUDGMENT Bhairo Prasad, Member. - This reference has been recommended by Additional Commissioner, Agra Division, Agra vide his recommendation dated 15.12.1982. 2. In the trial court the suit under Section 209 of U.P. Act No. 1 of 1951 was dismissed in default. Restoration application was filed. That was too dismissed on 7.11.1981. Again restoration application was filed to restore the restoration on 9.11.1981. The learned trial court has rejected the application vide his order dated 16.4.1982 against which order this revision was filed before the learned Additional Commissioner under Section 333-A of U.P. Act No. 1 of 1951. The learned Additional Commissioner under Section 333-A of U.P. Act No. of 1951. The learned Additional Commissioner has recommended that the restoration of the restoration application and as well as the restoration application for suit should be allowed on payment of costs of Rs. 50/-. 3. The revisionist is present through his counsel Sri R.K. yadav, Advocate. No one is present for the opposite parties. I have perused the record. 4. I, therefore, accept this reference, set aside the orders dated 7.11.1981 and 16.4.1982 and restore the suit on payment of costs of Rs. 50/-.
