JUDGMENT Bhairo Prasad, Member. - This reference has been recommended by the Additional Commissioner, Division Agra vide his recommendation dated 29.10.1979 under Section 333-A of U.P. Act No. 1 of 1951 arising out in a proceeding under Section 198(4) of U.P. Act No. 1 of 1951 decided by Addl. Collector, Agra in cases No. 22/23/24 of 1978-79. 2. I have heard the learned counsel for the applicant. No one is present from the side of the O.P. Perused the record. 3. In the trial court three application were given under Section 198(4) of U.P. Act No. 1 of 1951. They were decided by the trail court and allotment was cancelled in case no . 22 and 24 and case no. 23 was rejected on the ground that all the parties were not impleaded in that proceeding. The learned Additional Commissioner recommended the revision on the ground that no proceeding can be rejected on ground of non-joinder of the parties. I agree on the legal point. Therefore, the order of the trial court in case no. 23 is set aside and regarding case no. 22 and 24 there have no revision or recommendation, therefore, they need not to be considered. 4. The reference is accepted accordingly. Let the trial court be directed to decide the case afresh in accordance to law after impleading the necessary parties.
