JUDGMENT : 1. We have heard Mr. Govinda Mukhoty appearing on behalf of the petitioner and the learned counsel for the respondents. The questions which have been pressed in support of the special leave petition deserved consideration and disposal by the High Court by a reasoned judgment. Since the High Court has dismissed the writ petition in limine by merely stating that there is no merit in the case, we are of the view that the case should be remitted for reconsideration by the High Court and disposal of the writ case by judgment dealing with the points raised by the petitioner. Accordingly, we grant leave, allow the appeal, set aside the impugned judgment and remand the matter to the High Court. There will be order as to costs. 2. Mr. Mukhoty states that unless some interim orders are issues during the pendency of the writ petition, the officers represented by the petitioner Association will suffer serious injury. They may move the High Court in this regard. In the meantime for a period of two weeks, no further step shall be taken by the authorities in the present matter.
