JUDGMENT The appeal is time-barred. As per office report it is out of time by 68 days. Application under section 5 of the Limitation Act is filed for showing cause for the delay. To that no reply has come. Accordingly I direct the appeal to be registered, condoning the delay. On merits hearing taken up For death of a boy aged 13 years compensation in the sum of Rs.25,000/- for no fault liability is only granted finally. Owner has appealed complaining that the insurer could not be absolved of the liability. However, trial Court's finding is clear and categorical that deceased was a gratuitous passenger and in terms of the Insurance-policy the risk was not covered for such an accident. Obviously, therefore, the insurer-could not be held liable under the award passed. That apart, the appeal is also not in form and on that ground it is not maintainable because 50% of the sum awarded has not been deposited and that position is very clear from the order dated 16.7.1992. For all the aforesaid grounds this appeal stands dismissed.
