JUDGMENT M.R. Calla, J. - First bail application had been rejected on 2.6.1992. Challan has been filed in this case now. It is given out that in this case a recovery of 8.250 opium was shown to have been made from the present accused petitioner. It is submitted that the petitioner is in Jail since February 7, 1992 and he is not involved any other case in the N.D.P.S. Act. The petitioner also undertakes not to repeat offence in future. It is submitted that in several cases the bail has been granted where the recovery of the opium of much more quantity than that which is recovered in this case, had been made. In the facts and circumstances of this case. I am inclined to accept this bail application under section 439 Cr.P.C. and it is ordered that accused petitioner Moti Lal @ Dhanna Lal Son of Shri Devi Lal (illegible) in F.I.R. No. 1/92 Commissioner Narcotics Department, Kota under Section 8/18 of the Narcotic Drugs & Psychotropic Substances Act, be released on bail provided he furnishes a personal bond in the sum of Rs. 10,000/- together with two sureties in the sum of Rs. 5,000/- each to the satisfaction of the trial Court to appear before that Court whenever he is called upon to do so. *******
