JUDGMENT Bhairo Prasad, Member. - This reference has been made under Section 333-A of U.P. of Act No. 1 of 1951 by the Additional Commissioner, Moradabad Division, Moradabad vide his recommendation dated 24.4.1989. 2. In brief the facts of the case are that a notice was issued under Section 156/167 of U.P. Act No. 1 Of 1951 against Smt. janrail kaur wife of Lakhbir Singh that she does not cultivate the land personally and has given the land on batai. She contested the notice that she living in the village and manage to cultivate the land but the trial court on 22.11.1988 passed order for her ejectment and correction of records in favour of Gaon Sabha. The revision was filed against that order before the learned Additional Commissioner. The learned Additional Commissioner has recommended that the order passed by the trial court is illegal. 3. Nobody has appeared inspite of notice. Perused the record. 4. Smt. Janrail kaur is a lady. She cannot personally cultivate the land. She will need help of some person in the cultivation. If she takes any assistance from any person then she will not cease the right over the disputed plot. Therefore, the reference made by the Additional Commissioner is accepted and the proceeding dropped and the trial courts order dated 22.11.1988 is set aside and name of Smt. Janrail kaur should be restored in the revenue record.
