MOHINI KAPUR

body1992
JUDGMENT 1. - Out of the three accused in the case, application of Sanjay has been dismissed and the application of Lokendra has been allowed. The story of the prosecution is that three accused went at night to the house of Mahaveer Singh and demanded that he should withdraw the case against Lokendra. He said that they will talk the matter during the day time but Sanjay threw a bomb which exploded while this petitioner and Lokendra ran away. It may be said that the case of this petitioner is distinguishable from that of Sanjay as his hand grenade did not explode and that he was not caught at the site. Considering the facts and circumstances, this petitioner can be released on bail on appropriate conditions. 2. It is, therefore, directed that the accused petitioner Vijay Singh be released on bail provided he furnishes a personal bond in the sum of Rs. 5,000/- (Rupees Five Thousand only) with one surety in the like amount to the satisfaction of the trial court with the stipulation to appear before that court on each and every date of hearing and as and when called upon to do so during the pendency of the trail of this case against him with the further condition that he shall not keep any explosive substance in his possession. *******
