JUDGMENT R.K. Dhusiya, Member. - The reference has been made by the learned Additional commissioner, Gorakhapur Division, Gorakhpur by his recommending order dated 17.5.1983 by which he has recommended to allow the revision, set aside the order dated 4.11.1981 and remand the case back to the trail court for decision afresh. 2. Heard the learned counsel for the parties and have also seen the relevant papers on the file. 3. It appears that Ram Awadh filed an application for cancellation of the lease. The revisionist filed an objection. The trial court after taking evidence cancelled the lease. Aggrieved by that order a revision was filed before the learned Additional Commissioner who by his order dated 17.5.1983 made a recommendation to this court. Hence, the instant revision has come up before me. 4. In this case only it has been said that since the LMC has not been impleaded as party as such, the case should be remanded, I agree with the view expressed by the learned Additional Commissioner that non-impleadment of LMC has vitiated the entire proceeding before the trial court and as such the order of the trial court cannot be sustained. 5. In view of the above, I allow the revision, set aside the order dated 4.11.1981 and remand the case back to the trial court to decide the case afresh in the light of the observations made by the learned Additional Commissioner. The file be sent immediately for disposing off the case.
