Dhusiya, Member. - This revision has been filed against the order dated 9.4.1992 passed by the learned Additional Commissioner by which he dismissed the revision filed against the order dated 18.9.1991 passed by the trial court by which the trial court rejected the application for making spot inspection. 2. Heard the learned counsel for the revisionist and have also gone through the relevant paper on the file. 3. It appears that the plaintiff revisionist moved an application before the trial Court for making spot inspection. The trial court rejected the same holding that the application has been moved for delaying the case. Aggrieved by the order dated 18.9.1991 a revision was filed before the learned Additional Commissioner who by his order dated 9.4.1992 dismissed the revision holding that the revision is not maintainable as it is an interlocutory order. 4. The learned counsel has mainly argued that the disputed land is grove of the revisionist and no patta can be executed for the same. He further argued that the spot inspection of the plot is very essential to know the actual position on the spot and hence he prayed that it is just to facilitate the proper decision of the case the spot inspection must be allowed. In support of his contention he cited the ruling reported in 1983 R.D. page 34(Hindi). 5. I find that in the instant case the application for making the spot inspection was rejected by the trial court on 18.9.1991. The learned Additional Commissioner also rejected the revision holding that it has been filed against the interlocutory order. It is true that the present revision has been filed against and interlocutory order. In the ruling reported in 1983 R.D.p. 34 (Hindi) the Hon'ble High Court has held that in spite of application for making spot inspection. The authorities concerned did not make inspection as such the acts of the authorities is illegal and against the law. 6. I, therefore, set aside the orders dated 9.4.1992 and 18.9.1991 passed by the courts below and direct the trial court to decide the case afresh after making spot inspection and after affording the opportunity to the parties on merits. The revision is disposed off accordingly.
