JUDGMENT 1. - The petitioner Jagdish Prasad has filed this application under Section 438 Criminal Procedure Code under the following circumstances:- 2. One Hari Prasad Khandelwal has filed a complaint against the petitioner and two other co-accused in the court of Munsif Magistrate, Lansdon, Gadwal (U.P.). This complaint was filed on April 12, 1992, and the same was forwarded under sub-Section (3) of Section 156 Criminal Procedure Code. to Police Station-Lasdon for investigation, where, the case has been registered under Sections 406, 420, 467 and 468 Indian Penal Code. The arresting party having approached in Rajasthan to arrest the petitioner, he filed this application. 3. It shall not be proper for me to express any opinion about the merits of the case, as it shall be for the competent Court/Authority to decide the matter on merits. Suffice is to say, this application has been filed for a limited purpose to grant interim order so that the petitioner may appear before the competent Court/Authority and take necessary steps in this connection. Having heard the learned counsel for the petitioner and the learned Public Prosecutor, I am inclined to grant interim order in favour of the petitioner upto Nov. 10, 1992. 4. It is, therefore, directed that the petitioner shall not be arrested in Cr. Case No. 23/92 of Munsif Magistrate, Lansdon, Gadwal/FIR No. 19/92, PS-Lansdon, Gadwal. This indulgence for the aforesaid period is aimed so that the petitioner may take necessary steps before the competent Court/Authority for grant of his bail. *******
