JUDGMENT 1. - Heard the learned counsel for the petitioner and the learned P.P. Police papers perused. The learned counsel submits that initially the case was registered under Sections 341,323 and 324 Indian Penal Code, but subsequently Section 307 has been added, though there was no material on the record that the injury was sufficient in the ordinary course of nature to cause death of the injured Mangilal. He further submits that the size of the injury, as given by the doctor, is l/4" X l/6" and for depth there is a sign of interrogation and that there is no material on the record to show that the injury had damaged any internal part of the body. Learned counsel further submits that as per the X-Ray examination, no bony injury was found. 2. In the facts and circumstances of the case and the arguments advanced by both the sides, I am inclined to grant bail application under Section 439 Criminal Procedure Code. to the accused-Petitioner. 3. It is, therefore, ordered that the accused-petitioner Prabhu Lal s/o Kanhaiya Lal shall be released on bail provided he furnishes a personal bond in sum of Rs. 10,000/- (Rs. Ten Thousand) with two sureties in the amount of Rs. 5,000/- each to the satisfaction of the trial Court with the stipulation to appear in that Court or any other Court as and when called upon to do so during the pendency of the inquiry or trial, as the case may be, against him in this case. *******
