JUDGMENT Shri Gupta has submitted that applicants Ramcharan, Surjya, Banshi, Bajrang, Shambhu, Ramniwas and Jugraj were arrested by the Sheopurkalan Police on 29th. August, 1992, and that the first order for judicial remand was passed on 30.8.92 and that the charge-sheet was filed on 28.11.92. The aforementioned fact-situation is not disputed by the prosecution and the complainant. Shri Gupta has submitted that on these facts, these seven applicants (excluding Kailash) are entitled to be released on bail in terms of sub-clause (i) of clause (a) of the proviso below sub-section (2) of section 167, Cr.P.C. He submitted that the date on which the order for judicial remand was passed has to be included in computing the period men toned in sub-clause (i) of clause (a) of the proviso below sub-section (2) of section 167, Cr.P.C. This contention is based on Chaganji Satyanarayana v. State of A.P. [1986 SCC (Cri.) 321]. It is, therefore, clear that the charge-sheet was filed on the ninety first day, after the inclusion of the day 30th. August, 1992. Hence, applicants Ramcharan son of Prahlad, Meena, Surjya and Banshi sons of Mathuralal, Bajrang son of Tulsiram alias Tulsiya, Shambhu son of Dhanalal, Ramniwas son of Ramkunwar and Jugraj son of Pannalal are admitted to bail. They be released on personal bonds of five thousand rupees with two sureties in the like amount in each case to the satisfaction of the AOM, Sheopurkalan. 1986 SCC (Cri.) 321 followed. Application allowed.
