JUDGMENT : This Court by the order dated October 29, 1991 directed that the marriage between the parties be dissolved by the mutual consent. The husband was to pay a sum of Rs.5500/- to the wife before the application in terms of our order could be moved before the appropriate authority. The husband has not paid-the said amount. He is present in person before us and . states that he is not willing to pay the amount and he wants to take the wife alongwith him to his house. In this view of the matter we recall our order dated October 29, 1991. 2. We have heard learned counsel for the petitioner and Mr. Ashok Kumar in person. In the facts and circumstances of this case the petition under section 9 of the Hindu Marriage Act titled Ashok Kumar v. Anju Bala pending in the court of Additional District Judge, Rohtak, is transferred to the file of the District Judge, Delhi. The District Judge may hear the case himself or assign the same to any of the Additional District Judges for disposal. Transfer Petition is allowed. No costs. Contempt notice is discharged.
